Maple
(251) Limited is a Residents Management Company
originally formed by Westbury Homes in 2005. The company was
set up for the benefit of the purchasers
of 37 apartments (in Harleston House, Eaton House and Kemberton
House) and 14 houses (in Allington Avenue and Deykin Road) in the
Cathedral Walk Development of
Darwin Park, Lichfield, Staffordshire.
Ownership and
responsibility for the managment of the Company was eventually transferred
to the
property owners in 2012.
All
owners become Members (effectively shareholders) of Maple 251 when they
purchase a property in the development.
Agreements signed by the purchasers secure an equal share (per property) in Maple 251 and rights of access across the Amenity Land. New Members are committed to pay an annual "contribution" to Maple 251. The "contribution" (currently £120 p.a.(agreed by Members at the AGM) is 1/51st of Maple 251 expenditure including public liability insurance, maintenance, improvements, administration costs and allocations to an emergency reserve fund for urgent works.
When properties are
sold Maple 251’s written consent to the transfer of
ownership and membership is required. The vendor is obliged to arrange
for the purchaser to sign a Deed of Covenant applying for membership of
Maple 251. Transfer consent will not be unreasonably upheld providing
the vendor
is not in breach of covenant and/or the terms of their lease relating
to Maple 251. The Land Registry will not amend
the register with the buyer’s details until the consent has been given.

The
Company
is owned and managed entirely by the house and apartment owners
themselves. Volunteer Directors are
elected at the Annual General Meetings of Maple 251 to manage the
Company on
behalf of the members and carry out day to day administration tasks.
Members are eligible to
stand for election to the
5 Director positions for 2 or 3 year terms.
Key decisions on Maple 251 expenditure and management are taken by the members at AGMs. Members also discuss and decide courses of action on issues e.g. safety hazards, trespassing, security risks, speeding vehicles and indiscriminate parking. Approved spending has included remedial works, cleaning of block paving, painting and repairs to gates, installation of signs and gate locks.
There

Directors appointments open to Members
covering
the roles of Chair, Company Secretary, and Finance; in addition
to representative Directors for the apartment and house
owners. Elections/re-elections
for the positions of Maple 251 Directors take place at the Annual
General Meetings as follows:
Officer
appointments (Chair, Secretary and Finance): every 3 years
House and
Apartment owner representative appointments: every 2 years
The
current Directors are Nick Pollitt (Chair), Howard Lawrence
(Company Secretary), Richard Evens (Finance), Julie Pountney
(Apartment Owners representative) and Danny Greechan (House Owner
Representative).
